In order to protect the legitimate rights and interests of the insured, the insured, and the beneficiary, standardize the insurance sales behavior, and unify the supervision of insurance sales behavior, in accordance with the "Guiding Opinions of the People's Republic of China Insurance Law" and "General Office of the State Council on Strengthening the Protection of the Rights and Interests of Financial Consumers" In other laws and documents, the China Banking Regulatory Commission drafted the "Administrative Measures for Insurance Sales Behavior (Draft for Soliciting Opinions)" (hereinafter referred to as the "Administrative Measures"), and now publicly solicited opinions:

The "Administrative Measures" have 6 chapters and 49, which are general rules, pre -sales behavior management, behavioral management in insurance sales, insurance after -sales management, supervision and management, and attachment. The general rules clarify the scope of the method, the principles and classifications of insurance sales behavior, as well as the public education and information security protection obligations that insurance companies and insurance intermediaries need to bear. The second, third, and fourth chapters are based on the insurance sales process, and the rules of behavior rules for insurance pre -sales, insurance sales and insurance after sales respectively. Chapter 2 "Pre -Sales Behavior Management" mainly stipulates that insurance sales qualification conditions, business scope, insurance product information disclosure, insurance marketing publicity behavior, and technical preparation of insurance sales, personnel preparation, channel preparation, etc. Chapter III "Behavior Management in Insurance Sales" mainly stipulates that insurance companies informed their obligations, explain obligations, inquire about obligations, forbid for mandatory sale, and prohibited signatures. Chapter 4 "Insurance after -sales Management Management" mainly stipulates that the insurance company after the insurance contract is entered into the work requirements of the insurance policy, return visits, information notifications, and archives management. Chapter 5 Clarify relevant regulatory requirements and stipulates the administrative responsibilities of violations of the measures. The attachment is to make stipulations on the connection, measures explanation and implementation time of these measures with other regulatory systems.

The "Administrative Measures" is an important measure of the CBRC's implementation of the people -centered development ideas and effectively improving the sense of obtaining insurance consumers. It is the basic link of improving the behavior of the supervision system and the improvement of insurance sales behavior supervision framework. Based on the "Administrative Measures", the implementation rules of sub -fields will also be introduced to comprehensively and systematically standardize insurance sales behavior.

The CBRC will further revise and improve the "Administrative Measures" and release implementation in a timely manner in accordance with the feedback from various circles.
