The "Administrative Measures for the China Clean Development Mechanism Fund" has been reviewed and approved by the Ministry of Finance's Ministry of Finance on December 31, 2020. China's Clean Development Mechanism Fund Administrative Measures

Chapter 1 General Principles

Article 1 In order to strengthen and standardize the fundraising, management and use of the fund's cleaning development mechanism fund (hereinafter referred to as fund), to achieve the fund's purpose, and formulate these measures.

Article 2 The fund is a policy fund approved by the state and operates in accordance with the market -oriented model.

Article 3 The purpose of the fund is to support green low -carbon fields such as carbon peak carbon neutralization, climate change, pollution prevention and ecological protection, and promote the high -quality development of economic and society.

Article 4 The fundraising, management and use of the fund shall follow the principles of openness and fairness, safety norms, special funds, and performance.

Chapter 2 Fund Organization Fragrance

Article 5 The organizational structure of the fund consists of the fund policy guidance committee and the fund management center.

Article 6 The Fund Policy Guidance Committee is an intermediary of the fund affairs and is responsible for policy guidance to the fund.

The fund policy guidance committee is composed of representatives of the Ministry of Finance, the Ministry of Ecology and Environment, the Development and Reform Commission, the Ministry of Foreign Affairs, the Ministry of Science and Technology, the Ministry of Agriculture and Rural Affairs and the Meteorological Bureau.

The fund policy guidance committee has a co -chair, and is held by the representatives of the Ministry of Finance, the Ministry of Ecology and Environment, and the Development and Reform Commission.

The fund policy guidance committee has a secretariat, and the fund management center shall undertake specific work.

Article 7 The Fund Policy Guidance Committee fulfills the following responsibilities:

(1) Guidance on the basic management system for formulating funds;

(2) Policy guidance to the direction of fund development, medium- and long -term development strategies and business development;

(3) Guidance on support directions of fund gifts, paid use, etc. and other policies;

(4) Guidance on other major issues that affect the development of the fund.

Article 8 The fund management center is the fund management agency. It is responsible for the fund raising, management and use work, and shall be managed by the Ministry of Finance.

Article 9 Fund Management Center fulfills the following responsibilities:

(1) Drafting the basic management system of the fund, and formulate the specific operation management regulations of the fund;

(2) Funding and management fund funds;

(3) Organize and carry out funds for fund gifts and paid use;

(4) Supervision and management of funds and paid use of funds and paid use;

(5) Report the fund's annual business plan and its development, and other major matters to the fund policy guidance committee;

(6) Performing the duties of the Secretariat of the Fund Policy Guidance Committee;

(7) Carry out other activities that meet the purpose of the fund.

Chapter III Fund Raise

Article 10 Fund sources include:

(1) The revenue obtained by the transfers of greenhouse gas emissions through the clean development mechanism project belongs to all parts of the state;

(2) Fund operating income;

(3) Domestic and foreign institutions, organizations and individual donations;

(4) Other sources.

Article 11 The reduction of displacement referred to in these Measures refers to the reduction of greenhouse gas reduction transferred by the national approval and transfers through the cleaning development mechanism project; the revenue reduction revenue refers to the income obtained by the transfer and emission reduction.

Edimage revenue shall be owned by the state and the enterprise of the national and the implementation of the clean development mechanism projects in accordance with the prescribed proportion. The emission reduction income belongs to all parts of the country's all parts of the fund.

Article 12 The fund operating income referred to in these Measures refers to the income obtained by the fund to carry out paid usage within the scope of the use of these Measures.

Chapter 4 Fund Use

Article 13 The use of the fund shall be based on the principle of protecting the principle of benefit and the achievement of sustainable development, and adopt gifts and paid use.

Article 14 Fund supports the following project activities by arranging a certain scale of donations:

(1) Policy research and academic activities related to carbon peaks and carbon -to -climate change;

(2) International cooperation and exchange activities related to carbon peaks and carbon -carbon and cope with climate change;

(3) The purpose of strengthening the carbon peak carbon neutralization and response to the construction of climate change capabilities;

(4) The purpose of the public carbon peak carbon neutralization and the publicity and educational activities of climate change consciousness;

(5) Other projects that meet the purpose of the fund.

The annual expenditure scale of the fund gift is determined according to the earnings of the fund's previous annual income and the national carbon peak carbon neutralization, and the actual work of the climate change needs to be determined.

Article 15 The project application unit of the fund gift shall be the relevant departments of the provincial -level people's government at the provincial level related to the work of carbon peak carbon and climate change. The provincial ecological environment department is responsible for the organization and application of local gift projects. Article 16 The application, review, management, and evaluation and acceptance of the fund gift project shall be carried out in accordance with the relevant provisions of the fund gift project management.

The management measures for fund gift projects shall be formulated separately by the Ministry of Ecological Environment and the Ministry of Finance. The Ministry of Ecology and Environment leads the preparation of annual gift project guidelines.

Article 17 The fund supports the following project activities through paid usage:

(1) It is conducive to the realization of carbon peak carbon neutralization and generate project activities that respond to climate change efficiency;

(2) Implementation of project activities on the deployment of major decision -making deployment of national pollution prevention and ecological protection;

(3) Other project activities that meet the purpose of the fund.

Article 18 The fund is mainly used for paid use of the fund:

(1) Debt investment;

(2) Equity investment;

(3) Financing guarantee;

(4) Other methods stipulated by the state.

Article 19 The fund is paid to the use of professional institutions and implements professional management.

Various assets and equity formed by the fund formed by the fund shall be managed in accordance with the rules and regulations of the state.

Article 20 The organization and development of the fund's paid use shall be implemented in accordance with the management regulations of the Fund of the Ministry of Finance.

Article 21 Fund expenditures include gifts and basic management expenses.

The basic management fee expenses referred to in the preceding paragraph refer to the relevant expenses of the fund raising, management, and use, including the daily management fee of the fund management center, the fund business development fee, and other expenses.

Article 22 The Fund Management Center shall disclose the following information:

(1) Fund relevant policy documents;

(2) The declaration process of the fund gift project and the list of materials required;

(3) The development of funds and paid use and other businesses, except for state secrets and business secrets;

(4) Other information stipulated in laws and regulations should be made public.

Article 23 Fund and fund management centers shall build accounts separately, account for separate accounting, and strengthen supervision and management in accordance with the financial management of the Ministry of Finance's financial management, improve the performance of funds, and ensure the security of funds.

Article 24 The fund management center shall strengthen the risk management of the fund's use, and timely identify, analyze, evaluate and handle relevant risks.

Funds must not be used for sponsorship and donation expenditures that do not meet their purpose, and shall not engage in high -risk financial derivatives such as real estate, stocks, stock securities investment funds, and futures.

Chapter 5 Supervision and Inspection and Legal Responsibility

Article 25 The Ministry of Finance and the Ministry of Ecology and Environment shall strengthen the supervision and inspection of the funds of the fund, the development of the project, and the accounting data of the funds of the fund in accordance with the division of responsibilities.

Fund management centers shall supervise and manage the use of fund funds and output results in conjunction with relevant units, and report to the fund policy guidance committee in a timely manner.

Article 26 Fund and its management centers shall accept audit supervision implemented by the state audit organs in accordance with the law.

Article 27 Fund management centers shall review social audit institutions to audit the scale of fund income and expenditure, fund balance, fund operation status, and expenditure of the fund management center.

Article 28 Fund management units and their staff members who violate the rules stipulated in these Measures in the management of fund gift projects and paid project management and other major businesses. The corresponding responsibility in accordance with laws and regulations; if a crime is constituted, criminal responsibility is investigated in accordance with the law.

Article 29 If the fund use units and their staff are violated by the fund use of funds stipulated in these Measures, the relevant competent authorities shall order correction and investigate the corresponding responsibilities in accordance with laws and regulations; if they constitute a crime, criminal responsibility shall be investigated in accordance with the law.

Chapter 6 Attachment

Article 30 These Measures shall be explained by the Ministry of Finance, the Ministry of Ecological Environment, the Development and Reform Commission, the Ministry of Foreign Affairs, the Ministry of Science and Technology, the Ministry of Agriculture and Rural Affairs and the Meteorological Bureau.

Article 31 These Measures will be implemented from August 1, 2022. The Administrative Measures for the China Clean Development Mechanism Fund announced on September 14, 2010 (China Meteorological Bureau No. 59, China Meteorological Bureau No. 59 of the Ministry of Agriculture of the Ministry of Agriculture of the Ministry of Science and Technology of the Ministry of Foreign Affairs of the Ministry of Foreign Affairs of the Ministry of Finance) was abolished at the same time.
