It turned out that in September 2018, Zhang's ex -wife Lin, a dispute over a private lending dispute, went to Wuhan Xinzhou District People's Court. Zhang submitted Lin's "Authorized Entrusting Book" to the court, saying that it was involved in the lawsuit of the case by him. Since then, the trial and mediation process of the case have been involved in Zhang. In the end, the case was associated with a mediation and a civil mediation letter was issued by the court. Because Lin did not take the initiative to fulfill the obligation to determine the effective legal documents, in September 2020, the plaintiff of the case submitted the "Essay Application Form" to the court.

However, during the enforcement of the court, Lin asked the case to start retrial. Lin claimed that he did not know that the original trial had this case, nor did he authorize anyone to participate in the original trial lawsuit and signed, and raised his objection to the authenticity of the "Authorized Point Book". According to the handwriting identification, the signing of the "Authorized Entrusting Book" was finally confirmed that the name was written by Lin. Before the appraisal opinion, Zhang admitted that he was signed by his ex -wife.

Due to the violation of the voluntary principle of the original trial, the procedure has flaws, and the re -audit conditions are met, and the trial committee of the Xinzhou District Court discusses the decision, and the case starts the retrial procedure.

In civil litigation activities, even if the two parties are husband and wife or parents and children, they also have their own independent litigation status. One party has no right to represent the other party to perform litigation activities without real authorization. In the case, Zhang forged the authorized attorney, posing as others to participate in the lawsuit, which was a hindering judicial behavior and led to the retrial of the case, causing a waste of judicial resources, and should bear the corresponding legal liability. On July 8, 2022, the People's Court of Xinzhou District made a fine of 50,000 yuan on Zhang in accordance with the law.

The judge reminded that the Civil Procedure Law stipulates that it is impersonating to signature without obtaining the authorization of others and issuing a forged authorization attorney to the court to hinder civil lawsuits. The legitimate interests are damaged and seriously obstruct the order of litigation. The illegal act will be severely punished by law.
