Chapter 1 General Principles

Article 1 In order to prevent and control motor vehicles and non -road mobile mechanical discharge pollution, protect and improve the atmospheric environment, ensure public health, and promote the sustainable economic and social development, in accordance with the "Environmental Protection Law of the People's Republic of China" and "The People's Republic of China on the Prevention and Control Law of the People's Republic of China" This regulation is formulated in accordance with the actual situation of the province.

Article 2 The prevention and control of motor vehicles and non -road mobile mechanical discharge pollution in the administrative area of ​​the province is applicable to these regulations.

The motor vehicle referred to in these regulations refers to the power -driven or traction of the power device or traction.

The non -road mobile machinery referred to in these regulations refers to mobile machinery and transportable industrial equipment equipped with engines.

Article 3 The prevention and control of moving mechanical emission pollution of motor vehicles and non -road mobile roads shall adhere to the principles of prevention, combination of prevention and control, comprehensive governance, and regional synergy.

Article 4 The people's governments at or above the county level shall incorporate the prevention and control of motor vehicles and non -road mobile machinery discharge pollution into the prevention and control plan of air pollution in their administrative areas; establish a sound work coordination mechanism; ensure funding for funding; Supervision and management capabilities.

The competent authority of the ecological environment shall implement unified supervision and management of the prevention and control of motor vehicles and non -road mobile mechanical emissions in the administrative area.

The public security, transportation, market supervision and management of transportation, market supervision, business, housing and urban and rural construction, agricultural and rural areas, etc. within their respective responsibilities, the people's government at or above the county level shall implement supervision and management of motor vehicles and non -road mobile mechanical emissions pollution.

Article 5 The people's governments at or above the county level and their relevant departments shall strengthen the publicity and education of motor vehicles and non -road mobile machinery discharge pollution prevention and control laws, regulations and related knowledge; encourage and support the public welfare publicity of news media and social organizations.

Article 6 Any unit or individual has the right to complain and report to relevant departments such as the violation of these regulations. Relevant departments such as verification, ecological environment and other relevant departments shall be rewarded in accordance with regulations, and the information of the reporter shall be kept confidential.

The people's governments at or above the county level shall give commendation and rewards to units and individuals with significant results or outstanding contributions in motor vehicles and non -road mobile machinery emissions pollution prevention in accordance with relevant state regulations.

Chapter 2 Prevention and Control

Article 7 The people's governments at or above the county level shall strengthen the planning and planning of urban functions, optimize road settings and public transport facilities, and ensure the continuous and smooth flow of sidewalks and non -motorized lanes; prioritize the development of public transportation, green transportation, and promote intelligent transportation management.

Article 8 The people's governments of the municipal and state may reasonably control the amount of fuel engines in accordance with the needs of urban planning and air pollution prevention.

Article 9 The people's governments at or above the county level shall encourage the production, sales, energy conservation and environmental protection types and new energy motor vehicles, and non -road mobile machinery. Strengthen the construction of new energy supporting infrastructure, and increase the proportion of new energy vehicles in vehicles such as buses, taxis, and official vehicles year by year.

Article 10 The production, importing, and sales of motor vehicles and non -road mobile machinery fuels that do not meet the standards. It is forbidden to sell ordinary diesel and other non -motorized fuels to cars and motorcycles. It is forbidden to sell residue oil and heavy oil to non -road mobile machinery.

Article 11 Motor vehicles and non -road mobile mechanical pollutants discharge the discharge standards stipulated by the state.

Driving motor vehicles shall not discharge black smoke and other obvious visibility.

Article 12 It is forbidden to produce, import, and sell atmospheric pollutant emissions that exceed standards of motor vehicles and non -road mobile machinery.

Motor vehicles and non -road mobile machinery manufacturers should include motor vehicles and non -road mobile machinery emissions pollutants into product quality management to ensure that motor vehicles and non -road mobile mechanical air pollutants discharge to national standards; new production motor vehicles And non -road mobile machinery should be inspected. Those who have passed the inspection can be sold for sale. The inspection information should be disclosed to the society.

Article 13 The traffic management department of the public security organs shall not apply for registration and transfer to registration for motor vehicles that do not comply with the national regulations.

Relevant vehicles required to eliminate the elimination shall not be moved in across provinces or cross -prefectures.

Article 14 The owner or user of the mobile machines or the non -road mobile machinery shall maintain the pollution control device in normal working state, avoiding the discharge of pollutants from the discharge of pollutants from the failure of the device.

It is forbidden to dismantle, destroy, stop, modify motor vehicles and non -road mobile mechanical pollution control devices without authorization.

It is forbidden to destroy the diagnostic system of motor vehicle vehicle emissions.

Article 15 The people's governments at or above the county level may encourage and support high -emission motor vehicles and non -road mobile machinery in accordance with relevant national and provincial regulations.

Article 16 The municipal and county -level people's governments can determine the prohibited or restricted areas, time periods and models of high -emission motor vehicles according to the needs of urban planning and air pollution prevention and control, and delineate the use of high -emission non -road mobile machinery areas. And set up motor vehicles and non -road mobile machinery forbidden or restricting use signs. If the above -mentioned traffic control measures are taken, the society shall be announced to the society before implementing 30 days. Article 17 The people's governments at or above the county level shall start the emergency plan in a timely manner in accordance with the early warning level of severe pollution. Chapter III inspection and governance

Article 18 In accordance with relevant national or provincial regulations, the use of motor vehicles shall conduct regular discharge inspections by the motor vehicle emissions inspection agency. If the inspection or failure is not qualified, the traffic management department of the public security organs shall not issue a safety technical inspection of the security technology Sign.

It is forbidden to forge, change, or use the transfer of motor vehicle emission inspection reports that transfer, transfers, forge, and alteks; forbid the motor vehicle owner to pass the mobility emission inspection by using mobility vehicle emissions by temporary replacement of motor vehicle pollution control devices.

Article 19 The Provincial People's Government shall determine a unified use of motor vehicle emission inspection methods and technical specifications in accordance with relevant state regulations, and announce the implementation.

Article 20 The people's governments at or above the county level shall encourage motor vehicle emission inspection agencies and safety technology inspection agencies to set up at the same place; encourage the construction of motor vehicle inspection agencies that can undertake motor vehicle emission inspection and safety technology inspection at the same time.

Article 21 The owner or user of a motor vehicle may choose the motor vehicle emission inspection agency in accordance with the national regulations for the emission inspection.

Article 22 The motor vehicle emission inspection agency shall abide by the following provisions:

(1) Inspection in accordance with the national and provincial emission inspection methods and technical specifications;

(2) Pass the measurement certification in accordance with the law, and use the motor vehicle emission inspection equipment that is passed through the law;

(3) Networking with the competent department of the ecological environment, and transmit information such as inspection data and video images in real time to realize real -time sharing of inspection data;

(4) Establish a motor vehicle emissions inspection file, and save inspection information and related technical materials in accordance with the state regulations;

(5) Other matters stipulated in laws, regulations and technical specifications.

The motor vehicle emissions inspection agency and the person in charge are responsible for the authenticity and accuracy of the inspection data, and shall not forge the results of the discharge inspection or issue a false emission inspection report.

Article 23 If the inspection of the use of motor vehicle discharge is not qualified, it shall be maintained; after maintenance or pollution control technology, the discharge of air pollutants shall not meet the state's use of motor vehicle emission standards, shall be mandatory in accordance with relevant national regulations scrapped.

Article 24 The motor vehicle maintenance unit shall abide by the following requirements:

(1) Maintenance in accordance with the requirements of preventing and controlling atmospheric pollution and relevant national technical specifications, so that the maintenance motor vehicle meets the prescribed emission standards and provides corresponding maintenance service quality assurance;

(2) Do not provide temporary replacement motor vehicle pollution control devices, etc. to make fake services to make motor vehicles pass the emission inspection;

(3) Laws, regulations and other matters stipulated by the state.

Article 25 The competent department of ecological environment or other departments and staff who are responsible for supervision and management shall not interfere with the owner of the motor vehicle or the user to choose the emission inspection agency and maintenance unit; shall not sell or specify the use of motor vehicle emissions pollution control treatment Products; not participating in or participating in motor vehicle emission inspection operations and motor vehicle maintenance operations.

Article 26 The registration system for the coding of non -road mobile mechanical information. The non -road mobile machines used in this province shall register information such as basic information, pollution control technology information, and emission inspection information in accordance with relevant national and provincial regulations.

Article 27 If the pollution control device or pollution control device is not installed with heavy diesel vehicles, non -road mobile machinery, or pollution control devices cannot meet the requirements and cannot meet the standards, it shall be installed or replaced within the time limit prescribed by the competent department of the ecological environment. Pollution control device.

Chapter 4 Supervision and Management

Article 28 The people's governments at or above the county level shall incorporate the prevention and control of motor vehicles and non -road mobile machinery discharge pollution in the environmental protection goals of the administrative region, establish a coordination mechanism for pollution prevention and control and joint prevention and control management mechanism, and strengthen the prevention and control of pollution prevention and control. Supervision of implementation.

Article 29 The competent department of ecological environment of the Provincial People's Government may strengthen the supervision and inspection of the discharge of new production, sales of motor vehicles and non -road mobile machinery at air pollutants through on -site inspections and sampling testing.

The competent authority of the ecological environment can monitor the discharge of air pollutants using motor vehicles in concentrated parking land and maintenance. Without affecting normal traffic, remote sensing monitoring, electronic monitoring, camera camera, instrument and equipment monitoring can be used to monitor the discharge of motor vehicle pollutants on the road, and the traffic management department of the public security organs will cooperate.

The competent authorities of the ecological environment shall, together with relevant departments such as transportation, housing, urban and rural construction, agricultural and rural areas, etc., the discharge and inspection of air pollutants for non -road mobile machinery shall be supervised and inspected.

Article 30 The competent authority of the ecological environment shall be inspected and inspected the prevention and control of mobile vehicles and non -road mobile machinery emissions pollution pollution pollution pollution, market supervision and management departments in accordance with their duties, etc. Units and individuals should truthfully reflect the situation and provide relevant information, and must not refuse and obstruct. Department, institutions and staff who implement on -site inspections shall be conservative business secrets for the inspectors. Article 31 The competent authority of the ecological environment shall supervise and inspect the accuracy of the inspection of motor vehicle emission inspection agencies through on -site inspections and network monitoring, and announce the supervision and inspection results to the public.

Market supervision and management departments shall strengthen supervision and management such as measurement certification, effective maintenance of technical capabilities, and effectiveness of management systems for motor vehicle emission inspection agencies.

Chapter 5 Legal Responsibility

Article 32 In violation of these regulations, if laws and administrative regulations have stipulated administrative penalties shall be investigated for criminal responsibility in accordance with the law.

Article 33 If the provisions of Article 11, paragraph 2 of these regulations, the driving motor vehicle discharge black smoke and other obvious visual pollutants, after the ecological environment authority is obtained, the traffic management department of the public security organs shall order the traffic management department The driver of the motor vehicle was fined 100 yuan.

Article 34 In violation of Article 14 of these Regulations, those who dismantle, destroy, stop, modify motor vehicles and non -road mobile mechanical discharge pollution control devices shall be ordered to be corrected by the competent department of ecological and environmental and shall be ordered to be corrected for five thousand thousand RMB fine.

Article 35 If the provisions of Article 16 of these Regulations, drivers who drive high -emissions motor vehicles will be punished by the traffic management department of the public security organs in accordance with the law in accordance with the law in accordance with the law.

If the use of high -emission non -road mobile machines that prohibit the use of high -emission non -road mobile machinery are prohibited, the competent authority of the ecological environment shall be ordered to make corrections, and a fine of more than 5,000 yuan or less. RMB fine.

Article 36: In violation of Article 22 of these Regulations, the first paragraph, paragraph 1, paragraph, and the inspection institutions of the motor vehicle emission inspection institutions are not tested in accordance with the regulations, which may lead to unrealistic test results. The competent department ordered to make corrections, confiscated illegal income, and imposed a fine of more than 100,000 yuan.

In violation of Article 22, paragraph 1, paragraph and fourth, paragraph, paragraph 1 of these regulations, the motor vehicle emission inspection agency has not connected to the competent department of the ecological environment and transmits inspection data, videos and images in real time, or has not established motor vehicle emissions. If the inspection file and the inspection information and related technical information are preserved, the competent department of the ecological environment shall be ordered to make corrections, and a fine of 5,000 yuan is more than 20,000 yuan.

Article 37 The people's governments at all levels, the competent authorities of the ecological environment, and other departments with supervision and management responsibilities and their staff abuse their powers, neglect their duties, have fraud, and falsify them.

Chapter 6

Article 38 These regulations shall be implemented from October 1, 2022.
