Implementation measures for management of salt and salt specialty in Hebei Province

Chapter 1 General Principles

Article 2 These Measures are applied to the production, sales and reserve activities in the provincial administrative area.

Article 3 Salt implementation of special management management.

The people's governments at or above the county level shall strengthen the leadership of the salt specialization work, establish a professional regulatory system with consistent powers and responsibilities, improve the salt reserve system and emergency mechanism, and timely coordinate and solve major problems in the management of salt special business management.

Article 4 The salt industry department at or above the county level is responsible for the management of salt in the administrative area.

The market supervision and management department of the people's governments at or above the county level is responsible for the supervision and management of salt quality and safety in the administrative area.

The development of the people's governments at or above the county level, health, health, commerce, finance, public security and other departments do a good job of salt management related work in accordance with their respective responsibilities.

Article 5 The salt industry authorities at the people's government at or above the county level shall strengthen the management of non -edible salt such as industrial salt, and prevent non -edible salt from flowing into the salt market.

Article 6 The competent salt industry department of the Provincial People's Government shall, in conjunction with the relevant departments, organize the formulation of the province's salt industry development planning and related industrial policies, guide and support enterprises to increase salt varieties, improve the quality of salt, meet the needs of salt for different people, promote the salt industry in the salt industry High -quality development.

Encourage social capital to invest in salt enterprises in various forms, and promote the diversification, industrialization, and large -scale operation of salt industry enterprises.

Article 7 Salt operators shall engage in production and operation activities in accordance with laws, regulations, rules and food safety standards, fulfill the main responsibility of food safety and corporate social responsibilities, and safeguard the order of salt franchise and the legitimate rights and interests of consumers.

Article 8 The salt industry organization shall improve industry norms in accordance with the law, strengthen industry self -discipline, promote corporate law -abiding and integrity operations, guide enterprise fair competition, and protect corporate legitimate rights and interests.

Article 9 The people's governments and relevant departments at all levels shall strengthen the publicity and education of salt safety and scientific iodine supplementation, carry out the popularization of salt safety laws, regulations, regulations, and the popularization of salt safety standards and knowledge, advocate a healthy diet, strengthen consumer salt safety safety consciousness.

Chapter 2 Salt Production

Article 10 Strictly implement the fixed -point production system, and non -salt designated manufacturers shall not produce salt.

According to the relevant provisions of the State Council's "Salt Salt Specialty Measures", the Provincial People's Government's salt industry authorities shall be approved in accordance with the requirements of unified planning and reasonable layout to determine the designing enterprise of salt fixed -point production enterprises, and promptly announce the list of salt fixed production enterprises to the public, and the list It is reported to the competent salt industry department for the State Council for the record.

Article 11 Salt -point production enterprises and non -food salt manufacturers shall establish a production and sales record system, record and save relevant vouchers. Records and vouchers should not be less than two years.

Salt fixed -point manufacturers should record the following content truthfully:

(1) The number of raw salt, the date of purchase, and the name, address, and contact information of the supplier;

(2) The name, specifications, quantity, production date or production batch number, shelf life, inspection qualification certificate number of salt products;

(3) The sales date of salt products and the name, address, and contact information of the sales object.

Non -edible salt manufacturers should truthfully record the names, addresses, contact information and sales quantity of the sales object.

Article 12 The packaging and signs and labels of salt shall comply with national regulations.

The packaging and identification of non -edible salt products should be clearly different from salt, and significant labeling for industrial salt to prohibit consumption or non -edible salt on the packaging.

Article 13 It is forbidden to use the salt brine of wells to make salt.

Chapter III Salt Sales

Article 14 Strictly implement the wholesale system of salt fixed points, and non -salt -eating point wholesale enterprises shall not operate the salt wholesale business.

According to the relevant provisions of the State Council's "Salt Salt Specialty Measures", the Provincial People's Government's salt industry authorities shall be approved in accordance with the requirements of unified planning and reasonable layout to determine the wholesale enterprise of salt fixed -point salt points, and the list of salt fixed -point wholesale enterprises will be announced to the society in a timely manner, and the list of salt fixed -point wholesale enterprises will be announced in a timely manner, and the list of salt fixed -point wholesale enterprises will be announced in a timely manner. Article 16 Salt -point wholesale enterprises shall establish a procurement and sales record system, record and save relevant vouchers. Records and vouchers should not be less than two years.

Salt fixed -point wholesale enterprise should record the following content truthful:

(1) The name, address, and contact information of the purchase of salt salt and salt fixed -point wholesale enterprises;

(2) The name, specifications, quantity, production date or production batch number, shelf life, and purchase date of the purchase of salt salt;

(4) The name, address, and contact information of the sales object.

Article 17 The provider of the third -party platform of online transactions shall provide real -name registration of the operators of the net salt to clarify their food safety management responsibilities; if they shall obtain a license in accordance with the law, they shall also review their licenses.

If the provider of the third -party platform of online transactions finds that there are illegal acts in the online food salt, it shall stop and report the market supervision and management department of the county -level people's government in a timely manner; if a serious violations are found, it shall immediately stop providing online trading platform services.

Article 18 The containers, tools and equipment of storage, transportation, and loading and removing salt shall meet the requirements of food safety, and shall not store and transport salt with toxic and harmful items.

Article 19 Salt retail units shall purchase salt from fixed -point salt wholesale enterprises, and establish a salt purchase inspection record system in accordance with the provisions of the Food Safety Law of the People's Republic of China, record relevant content and save relevant records and vouchers.

Article 20 Salt retail units shall not sell bulk salt, and catering service providers shall not purchase, store or use bulk salt.

Article 21 The price of salt is determined by the operator.

The price authorities of the people's governments at or above the county level shall strengthen the daily monitoring of the market for salt retail prices. When the price of salt rises significantly or may rise significantly, the price authorities of the provincial people's government may propose price intervention measures in accordance with the law, report to the provincial people's government for approval, and report it to the State Council for the record. After the price of salt is stable, price intervention should be lifted in time.

Article 22 The supply of iodine salt should be guaranteed, and the supply of non -iodine salt should be guaranteed. If iodine salts should not be consumed due to the treatment of diseases in the iodine deficiency area, they shall purchase non -iodized salt at the designated sales outlet designated by the salt industry department of the local people's government in accordance with relevant national regulations.

Article 23 Salt prohibits salt that does not meet food safety standards.

It is forbidden to sell the following products as salt:

(1) liquid salt (including natural brine);

(2) Industrial salt and other non -food salt;

(3) Salt made of salt soil, nitrate soil or industrial waste residue, and waste liquid;

(4) Salt used to use the salt brine of wells;

(5) There are no signs or signs on the outer packaging that do not meet the relevant regulations of the state.

Chapter 4 Salt Reserve and Emergency Affairs

Article 24: Salt is included in the conservation catalog of important provincial materials.

The provincial salt reserve department shall establish and improve the salt reserve system in accordance with the provincial salt supply and demand status, and strengthen the supervision and inspection of the number of salt reserves, quality and storage safety of the provincial government.

The salt reserves of the provincial government should not be lower than the average monthly consumption of salt in the province in the first year.

Encourage the city and county -level people's governments to carry out government salt reserves.

Article 25 Salt -point production enterprises and salt fixed -point wholesale enterprises shall assume the responsibility for salt salt reserve in accordance with the requirements of the salt reserve system, and maintain a reasonable inventory of salt.

Enterprise salt reserves shall not be lower than the average monthly sales of salt in the previous year.

Article 26 Units and enterprises that undertake the responsibility of salt reserve shall strengthen the management of salt salt in accordance with important material reserves and food quality and safety, implement special library or stack storage, and regularly carry out rotation to ensure the quality of reserve salt salt And safety.

Article 27 The competent salt industry department of the people's government at or above the county level shall, in conjunction with the relevant departments, formulate a salt supply emergency plan, coordinate and ensure salt supply when emergencies occur, and do a good job of information release in accordance with the law. Salt -point production enterprises and salt designated wholesale enterprises shall do a good job of salt production and supply in accordance with the requirements of emergency plans.

Chapter 5 Supervision and Management

Article 28 The salt industry authorities and market supervision and management departments of the people's governments at or above the county level shall strengthen collaboration, cooperate with each other, and implement information sharing through the government information system, and establish and improve the system of administrative law enforcement collaboration and cooperation.

Article 29 The competent salt industry department of the people's government at or above the county level shall strengthen the monitoring and analysis, early warning and judgment of salt production and sales, and timely grasp the supply and demand of the salt market. Salt -point production enterprises and salt designated wholesale enterprises shall notify the production and sales information in accordance with relevant national regulations, to inform the local people's governments of the county -level people's governments in accordance with relevant national regulations.

Article 30 The competent salt industry department of the Provincial People's Government shall establish and improve the management platform for salt to traceable, strengthen the management of information such as salt production, wholesale, storage, retail, etc., and realize the traceability and flow of salt sources.

Article 31 The competent department of salt industry and relevant departments at the people's government at or above the county level shall regulate the production and operation behavior of salt in accordance with the law, and find that there are hidden salt safety hazards during salt production and operation. Essence Salt operators should immediately take measures to rectify and eliminate hidden dangers. For companies and individuals who have serious illegal dishonesty, they shall implement joint disciplinary in accordance with the law. Article 32 The competent department of salt industry at the county level at or above the county level performs the responsibilities of supervision and inspection, and the following measures may be taken according to law:

(1) Know the situation from relevant units and individuals;

(2) Check or copy relevant information about contracts, bills, account books, purchase and sales records and other relevant information;

(3) Seeing and seizure of salt and raw materials related to the illegal behavior of the salt industry, as well as tools and equipment for illegal production or sales of salt;

(4) Checking places suspected of illegal production or salt.

The measures stipulated in the third and fourth paragraphs of the preceding paragraph shall be reported in writing to the main person in charge of the salt industry department and approved.

The competent department of salt industry investigates the suspected illegal act of salt industry, and shall abide by the "Administrative Compulsory Law of the People's Republic of China" and other relevant laws and regulations.

Article 33 The salt industry authorities and market supervision and management departments of the people's governments at or above the county level shall announce the contact information of their departments to the society, accept complaints and reports on salt specialty and salt quality and safety, and investigate and deal with it in a timely manner. Reporting a real name should be kept confidential and inform the reporter of the processing results.

Chapter 6 Legal Responsibility

Article 34: If the provisions of Article 10 and 14 of these Measures, non -salt -point production enterprises produce salt and non -salt -stable wholesale enterprises to operate the salt wholesale business shall be given in accordance with Article 26 of the "Salt Specialty Measures" Penalty.

Article 35: Article 11, 15, 16, and 23 of these Measures, Article 11, 16, and 23 of the Salt Salt Production Enterprise and Non -Edible Salt Production Enterprises The wholesale enterprise exceeds the scope of salt stipulated by the state or fails to preserve the purchase and sales record in accordance with regulations. If the non -edible salt products are sold as salt, the punishment shall be punished in accordance with Article 27 of the "Salt Specialty Measures".

Article 36 If the provisions of Article 12 of these Measures shall be imposed in accordance with the relevant regulations of the state, a punishment shall be imposed in accordance with Article 29 of the "Salt Specialty Measures".

Article 37 The provisions of Article 15 and 19 of these Measures, Salt -point wholesale Enterprises purchased salt from units or individuals other than those wholesale enterprises other than salt -salt, other salt -stables, and salt retail units from salt fixed points from salt points. Units or individuals other than wholesale companies purchase salt shall be punished in accordance with Article 28 of the Salt Specialty Measures.

Article 38: In violation of Article 20 of these Measures, those with salt retail units selling bulk salt, or catering service providers to procurement, storage, and use of bulk salt shall be ordered by the market supervision and management department of the people's government at or above the county level. If you correction, a warning is given and a fine of more than 30,000 yuan.

Article 39 If you violate the provisions of these Measures at the same time that violates the Food Safety Law of the People's Republic of China, the market supervision and management department of the people's government at or above the county level shall be punished in accordance with the Food Safety Law of the People's Republic of China.

Article 40 If you violate the provisions of these Measures and constitute a violation of public security management, the public security organs shall be punished by public security management according to law; if a crime is constituted, criminal responsibility shall be investigated in accordance with the law.

Article 41 The salt industry authorities of the people's government at or above the county level and staff of other relevant departments abuse their powers, neglect their duties, and have the fraud, and constitute a criminal responsibility in accordance with the law; if they do not constitute a crime, they shall be punished according to law.

Chapter 7

Article 42 In addition to the provisions of these Measures, the supervision and management of salt quality and safety and salt and iodine shall also be implemented in accordance with relevant laws and regulations.

Article 43 These Measures will be implemented from October 1, 2022.
