The General Administration of Market Supervision recently issued the "Measures for the Supervision and Administration of Drug Network Sales" (hereinafter referred to as the "Measures"), which stipulates that third -party platforms should set up drug quality and safety management institutions, equipped with pharmacy and technical personnel, establish and implement drug quality safety, drug information display, prescriptions, prescriptions Review, prescription drug real -name purchase, drug delivery, transaction record preservation, adverse reaction report, complaint report processing and other management systems. The Measures will be implemented from December 1, 2022.

The "Measures" require that pharmaceutical network sales enterprises must be offline physical pharmaceutical companies, and drug listing licenses or operating companies that obtain drug business licenses can develop drug network sales business. Vaccium, blood products, anesthesia drugs, psychotropic drugs, medical drugs, radioactive drugs, pharmaceuticals, and vulnerable toxic chemicals shall be sold on the Internet. Pharmaceutical network retail enterprises shall not violate regulations to give individuals and category A non -prescription drugs to individuals by buying drugs and giving medicines.

The third -party platform plays a unique role in the sales of pharmaceutical networks, and the "Measures" make a series of regulations on the management of third -party platforms. In addition to the above -mentioned drug quality and safety management institutions, the "Measures" also requires the platform to sign an agreement with the drug network sales enterprise to clarify the responsibility of drug quality and safety on both sides. It stipulates that the platform should perform the review, inspection and monitoring, and discover serious violations of laws. Obligations such as stopping services and reports, and strengthening the platform's cooperation obligations in drug recalls, emergency emergency response, and supervision and inspection.

Considering the safety risk of medication and consistent management requirements for online and offline, the Measures clearly implement a real -name system for the sales of prescription drug networks, and conduct prescription review and deployment in accordance with regulations. Before the prescription review, no information such as the manual shall be displayed, and the relevant services of the prescription medicine purchase shall not be provided. The prescription drug should be displayed from the non -prescription medicine. On the homepage of the prescription drug sales, the information such as packaging, labels and other information shall not directly display the packaging, labels and other information.
