Administrative Measures for Practicing Veterinary Medicine and Rural Veterinary Medicine

Chapter 1 General Principles

Article 1 In order to protect the legitimate rights and interests of practicing veterinarians and rural veterinarians, standardize animal diagnosis and treatment activities, strengthen the construction of veterinarians and rural veterinary doctors, and ensure animal health and public health and safety, and formulate these measures in accordance with the "Animal Epidemic Prevention Law of the People's Republic of China".

Article 2 The practice veterinarians referred to in these Measures include practicing veterinarians and practicing assistants.

The rural veterinarian referred to in these measures refers to the person who has not obtained the qualifications of practicing veterinarians and has been filing in the countryside to engage in animal diagnosis and treatment activities in rural areas.

Article 3 The Ministry of Agriculture and Rural Affairs is in charge of the management of veterinary veterinarians and rural veterinary medicine, strengthen information construction, and establish and improve the management system for practicing veterinarians and rural veterinary medicine.

The agricultural and rural authorities of the Ministry of Agriculture and Rural Government and the competent agricultural and rural authorities of the provincial people's government formulate a continuing education plan for practicing veterinarians and rural veterinarians to improve the quality and level of practice of practicing veterinarians and rural veterinary medicine.

The agricultural and rural authorities of the local people's government at or above the county level is in charge of the management veterinarian and rural veterinary medicine management in the administrative area, and strengthen the supervision and management of practicing veterinarians and rural veterinary records, practicing activities, and continuing education.

Article 4 Encourage practicing veterinarians and rural veterinarians to receive continuing education. Practicing veterinarians and rural veterinarian continuing education can entrust relevant institutions or organizations to undertake specifically.

The institution of practicing veterinarians shall support practicing veterinarians to participate in continuing education.

Article 5 The practice veterinarian and rural veterinarians are practiced according to law, and their rights are protected by law.

The Veterinary Industry Association shall strengthen industry self -discipline in accordance with laws, regulations, rules, and articles of association, reflect industry demands in a timely manner, and provide veterinary practitioners with information consulting, propaganda training, rights protection, dispute treatment and other services.

Article 6 The practice veterinarian and rural veterinarian who have made outstanding contributions in animal epidemic prevention work shall be given commendation and rewards in accordance with relevant national regulations.

For practicing veterinarians and rural veterinarians who are involved in animal epidemic prevention, disability, and death, subsidies or pensions shall be given in accordance with relevant national regulations.

The people's government of the county -level people's government agricultural and rural areas and township (town) people's governments shall give priority to determining rural veterinarians as village -level animal epidemic preventions.

Chapter 2 Practice Veterinary Qualification Exam

Article 7 The state implements a system of practicing veterinary qualification examinations.

If you have one of the following conditions, you can sign up for the national practice veterinarian qualification examination:

(1) Personnel with a college degree or above or a full -time college student in the university, which is professional in line with the professional catalog published by the National Practicing Veterinary Qualification Examination Committee;

(2) Professional and technical titles of veterinarians have been obtained before January 1, 2009;

(3) Rural veterinarians who have filed or register according to law and have been engaged in animal diagnosis and treatment activities for more than ten years.

Article 8 The qualification examination of the veterinary veterinarian is organized by the Ministry of Agriculture and Rural Ministry, and the national unified outline, unified propositions, unified examinations, and unified evaluations.

Article 9 The qualification examination category of the veterinary veterinarian is divided into the total veterinarian and aquatic animals, including four -door subjects of foundation, prevention, clinical and comprehensive application.

Article 10 The National Practicing Veterinary Qualification Examination Committee established by the Ministry of Agriculture and Rural Affairs is responsible for reviewing examination subjects and examination outlines, issuing examination announcements, determining examination papers, etc., supervising, guiding and determining qualified standards for the examination work.

Article 11 The persons who pass the qualification examination of the veterinary veterinarian shall be issued by the competent agricultural and rural authorities of the people's governments of the province, autonomous region, and municipality directly under the Central Government.

Chapter III Practice Records

Article 12 Anyone who obtains the qualification certificate of the veterinary veterinarian and engage in animal diagnosis and treatment activities in animal diagnosis and treatment institutions shall be filed with the record agency where the animal diagnosis and treatment institutions are located.

Article 13 If you have one of the following conditions, you can record it as a rural veterinarian:

(1) Obtain related professional qualifications such as medium or above veterinarians, animal husbandry (animal husbandry and veterinary), traditional veterinary medicine (ethnic veterinary), aquaculture and other related majors;

(2) Obtaining the prevention and treatment of animal epidemic diseases above the intermediate level, occupational skills appraisal certificate or occupational skills level certificate;

(3) Having been engaged in village -level animal epidemic prevention staff for five years.

Article 14 If a veterinarian or a rural veterinarian filing shall be recorded, the following materials shall be submitted to the filing authority:

(1) Record information table;

(2) Identity certificate.

In addition to the materials stipulated in the preceding paragraph, the filing of veterinarians shall also submit a certificate of employment of animal diagnosis and treatment institutions. Rural veterinary filing shall also submit a certificate of education, vocational skills appraisal or vocational skills level certificate.

Article 15 If the filing material meets the requirements, it shall be recorded in time; if the requirements shall not meet the requirements, the recorder shall be notified to the relevant materials of the recorder at one time.

The filing agency shall optimize the filing process, gradually achieve unified online handling, and improve the filing efficiency.

Article 16 Practicing veterinarians may record a number of practicing animal diagnosis and treatment institutions in the same county; if they engage in animal diagnosis and treatment activities in different counties, they shall be filed with the filed institutions where the animal diagnosis and treatment agencies are located.

If a practicing animal diagnosis and treatment agency changes, the filing information shall be updated in a timely manner in accordance with regulations.

Chapter 4 Management of Practice Activity

Article 17 Practicing veterinarians and rural veterinarians who suffer from infectious diseases with people and animals shall not engage in animal diagnosis and treatment activities directly.

Article 18 Practicing veterinarians shall be practiced at the animal diagnosis and treatment institutions filing, except for consulting, support, invitation, first aid, etc. of animal diagnosis and treatment institutions.

Practicing veterinarians who are specially engaged in the diagnosis and treatment of aquatic animal epidemic disease shall not engage in the diagnosis and treatment of other animal epidemic diseases. Rural veterinarians shall engage in animal diagnosis and treatment activities in rural areas where the filing agency is located, and shall not be employed in urban areas.

Article 19 The veterinarian may engage in activities such as prevention, diagnosis, treatment and prescriptions of animal diseases, prescribing prescriptions, filling in diagnostic letters, and issuing animal diagnosis and treatment documents.

Practicing assistant veterinarians can engage in animal health examination, sampling, distribution, administration, acupuncture and other activities. Under the guidance of practicing veterinarians, surgery and dissectional activities are assisted, but no prescriptions, filling in diagnostic letters, and issuing animal diagnosis and treatment documents must not be issued. Article 20 Practicing veterinarians shall regulate the prescriptions and medical records. Without personal diagnosis and treatment, no prescriptions, filling in the diagnostic letter, and issuing animal diagnosis and treatment documents shall be issued.

Practicing veterinarians shall not forge the results of the diagnosis and issue a document for the diagnosis and treatment of false animals.

Article 21 Veterinary students related to the practice of animal diagnosis and treatment teaching practice have not obtained a licensed veterinarian qualification certificate and participating in work practice in animal diagnosis and treatment institutions. Diagnosis and treatment activities.

Article 22 Practice veterinarians and rural veterinarians shall fulfill the following obligations in practice:

(1) Comply with laws, regulations, rules, and relevant management regulations;

(2) Regarding animal diagnosis and treatment activities in accordance with technical operations;

(3) Observe professional ethics and fulfill the duties of veterinary medicine;

(4) Love animals, propagate animal health knowledge and animal benefits.

Article 23 Practicing veterinarians and rural veterinarians shall use veterinary drugs and veterinary equipment in accordance with relevant national regulations, and shall not use the drugs and other compounds that are prohibited from using fake and inferior veterinary drugs, the Ministry of Agricultural and Rural Ministry, and veterinary equipment that does not meet the requirements.

If a veterinarian and rural veterinarians find that a serious adverse reaction may be related to the use of veterinary drugs and veterinarian equipment, it shall immediately report to the competent agricultural and rural authorities of the people's government in the local people's government.

Article 24 Practicing veterinarians and rural veterinarians shall deal with veterinary equipment and diagnosis and treatment wastes used in accordance with regulations.

Article 25 If a veterinarian and rural veterinarians find animal infection or suspected infection during animal diagnosis and treatment activities, they shall immediately report to the competent agricultural and rural authorities of the people's government or animal epidemic prevention and control institution in accordance with national regulations, and quickly adopt isolation of isolation. , Disinfection and other control measures to prevent animal epidemic from spreading.

Practicing veterinarians and rural veterinarians shall not be treated without permission when they find an epidemic that is suffering from animals or suspected of suffering from state regulations.

Article 26 Practicing veterinarians and rural veterinarians shall participate in animal epidemic prevention, control and animal epidemic extinguishing activities in accordance with the requirements of the local people's government or the competent agricultural and rural authorities.

Practicing veterinarians and rural veterinarians can carry out animal epidemic prevention and epidemic diagnosis and treatment activities by undertaking government purchase services.

Article 27 The veterinarian shall be reported to the last year's veterinary practice activities in accordance with the requirements of the agricultural and rural authorities of the county -level people's government before the end of March each year.

Article 28 The competent agricultural and rural authorities of local people's governments at or above the county level shall establish and improve the daily regulatory system, and supervise and inspect the implementation of laws, regulations, and rules in the implementation of veterinarians and rural veterinarians in the jurisdiction.

Chapter 5 Legal Responsibility

Article 20: If there is one of the following behaviors in violation of these Measures, the veterinarians shall be punished in accordance with Article 106, paragraph 1 of the "Animal Epidemic Prevention Law of the People's Republic of China":

(1) Those who engage in animal diagnosis and treatment activities during the suspension of animal diagnosis and treatment;

(2) Those who are engaged in animal diagnosis and treatment activities in the county or practice scope of the county;

(3) Practicing assistant veterinarians directly perform surgery, or issue prescriptions, fill in diagnostic letters, and issue relevant certification documents for animal diagnosis and treatment.

Article 30 Visitors who violate these Measures, practice veterinarians treats animals that are affected by or suspected of being affected by state regulations, and cause or cause animal epidemic dissemination and popularity. Article 106, paragraph 2, punishment.

Article 32 In violation of the provisions of these Measures, those who practice veterinarians have one of the following acts in animal diagnosis and treatment, shall be ordered by the agricultural and rural authorities of the local people's government at or above the county level to make corrections within a time limit, and a fine of less than 5,000 yuan or less:

(1) Do not use the medical records, or the prescription should be prescribed without prescription;

(2) Fill in prescriptions and medical records from irregularities;

(3) Without personal diagnosis and treatment, prescriptions, fill in the diagnostic letter, and issue the relevant certification documents of animal diagnosis and treatment;

(4) Forgery of diagnosis results, and issuing false animal diagnosis and treatment documents.

Article 33 In violation of the provisions of these Measures, if a rural veterinarian does not engage in animal diagnosis and treatment activities in accordance with the regulations of the filing regulations, the agricultural and rural authorities of the local people's government at or above the county level shall order corrections within a time limit, and shall be fined 1,000 yuan to 5,000 yuan.

Chapter 6 Affiliated

Article 34 The persons who have obtained practicing veterinary qualification certificates hired by an animal breeding ground, experimental animal breeding units, veterinary drug production enterprises, zoo and other units may apply for practicing veterinarians with employment contracts, but no animal diagnosis and treatment activities shall be carried out. Article 35 The competent agricultural and rural departments of the people's government of the province, autonomous region, and municipality may determine the practice assistant veterinarian in the countryside in accordance with the actual situation of the region and engage in animal diagnosis and treatment activities independently in the countryside, and conduct practicing activities in accordance with practicing veterinarians.

Article 36 The record agency referred to in these Measures refers to the agricultural and rural authorities of the people's government of the county (municipal jurisdiction) level; if there is no competent agricultural and rural authorities in the municipal area, the filing authority is the competent agricultural and rural authorities at the higher level.

Article 37 These Measures will be implemented from October 1, 2022.
